APPLICATION OF THE INTERNATIONAL CONVENTION ON THE ELIMINATION OF ALL FORMS OF RACIAL DISCRIMINATION (ARMENIA v. AZERBAIJAN)
The President of the International Court of Justice,
Having regard to Article 48 of the Statute of the Court and to Article 79bis, paragraphs 1 and 3, of the Rules of Court,
Having regard to the Application filed in the Registry of the Court on 16 September 2021, whereby the Republic of Armenia instituted proceedings against the Republic of Azerbaijan concerning alleged violations of the International Convention on the Elimination of All Forms of Racial Discrimination of 21 December 1965,
Having regard to the Order of 21 January 2022, whereby the Court fixed 23 January 2023 and 23 January 2024 as the respective time-limits for the filing of the Memorial of the Republic of Armenia and the Counter-Memorial of the Republic of Azerbaijan,
Having regard to the Memorial of Republic of Armenia filed within the time-limit thus fixed;
Whereas, on 21 April 2023, the Republic of Azerbaijan filed preliminary objections to the jurisdiction of the Court, and whereas a signed copy of those preliminary objections was immediately transmitted to the other Party;
Whereas, accordingly, by virtue of Article 79bis, paragraph 3, of the Rules of Court, the proceedings on the merits are suspended and a time-limit has to be fixed for the presentation by the other Party of a written statement of its observations and submissions on the preliminary objections;
Taking account of Practice Direction V, pursuant to which the time-limit for the presentation of such a written statement shall generally not exceed four months from the date of the filing of the preliminary objections,
Fixes 21 August 2023 as the time-limit within which the Republic of Armenia may present a written statement of its observations and submissions on the preliminary objections raised by the Republic of Azerbaijan; and
Reserves the subsequent procedure for further decision.
Done in English and in French, the English text being authoritative, at the Peace Palace, The Hague, this twenty-fifth day of April, two thousand and twenty-three, in three copies, one of which will be placed in the archives of the Court and the others transmitted to the Government of the Republic of Armenia and the Government of the Republic of Azerbaijan, respectively.
